Introduction

These Terms of Service (“Terms”) govern your access to and use of Hokusa.app (“the Service”). By accessing the Service, creating an account, or using any feature, you agree to these Terms. If you do not agree, do not use the Service.

The Service

The Service provides AI-powered image, video, and audio generation and editing, history management, credit-based usage, and paid plans (subscriptions and one-time purchases). Features, models, pricing, and credit amounts may change with notice where required. See the pricing page and in-app displays for current details.

Accounts

• Register with accurate and up-to-date information.
• You are responsible for safeguarding your credentials and all activity under your account.
• You may not sell, transfer, or share your account except as permitted by law.
• We may suspend or terminate accounts suspected of abuse or violation of these Terms.

Acceptable Use

You must not:

• Violate applicable law or infringe intellectual property, privacy, publicity, or other rights
• Generate or distribute child sexual abuse material, non-consensual sexual content, extreme violence, hate, or discriminatory material
• Distribute malware, spam, phishing, impersonation, or disrupt the Service
• Circumvent rate limits, security, or billing controls
• Resell or white-label the Service or outputs without our written permission (except commercial use expressly allowed by your plan)
• Use bots or automation to abuse credits or infrastructure

We may remove content, suspend accounts, or take legal action for violations.

Credits, Billing, and Refunds

• Free tiers, subscriptions, and credit packages are governed by the terms shown at purchase and Stripe billing records.
• Subscriptions may renew until canceled. Refund and cancellation rules follow plan disclosures and applicable law.
• Payments are processed by third parties such as Stripe. We may restrict access for chargebacks or suspected fraud.
• Refunds for unused credits depend on plan type and promotional terms.

Commercial Use

Certain paid plans may permit commercial use of outputs. Permitted uses (social media, ads, client work, etc.) are described on the pricing page and FAQ. You are solely responsible for ensuring your use does not infringe third-party rights.

Intellectual Property

• We (or our licensors) own the Service software, UI, branding, and documentation.
• You retain rights in your prompts and uploads to the extent provided by law.
• Rights in AI outputs are granted only as described in these Terms and your plan. We do not warrant that outputs are unique, non-infringing, or suitable for any particular purpose.
• We may use anonymized or aggregated inputs and outputs to improve the Service, detect abuse, and run analytics.

Disclaimers

THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS. USE OF GENERATED CONTENT IS AT YOUR OWN RISK.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR A REASONABLE CAP FOR FREE USERS).

Third-Party Services

The Service relies on third parties for authentication, payments, AI inference, analytics, and hosting. Their terms and policies may apply. We are not responsible for third-party acts or outages.

Termination

You may delete your account at any time. We may suspend or terminate access for violations, inactivity, or legal compliance, with or without notice where permitted. Sections on payment, intellectual property, disclaimers, and liability survive termination.

Governing Law

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, except where mandatory consumer protection laws provide otherwise.

Changes

We may modify these Terms. Material changes will be posted on the Service. Continued use after changes constitutes acceptance.
