Terms governing your use of Hokusa AI image generation

These Terms of Service (“Terms”) govern your access to and use of Hokusa.app (“the Service”). By accessing the Service, creating an account, or using any feature, you agree to these Terms. If you do not agree, do not use the Service.
The Service provides AI-powered image, video, and audio generation and editing, history management, credit-based usage, and paid plans (subscriptions and one-time purchases). Features, models, pricing, and credit amounts may change with notice where required. See the pricing page and in-app displays for current details.

Certain paid plans may permit commercial use of outputs. Permitted uses (social media, ads, client work, etc.) are described on the pricing page and FAQ. You are solely responsible for ensuring your use does not infringe third-party rights.
THE SERVICE IS PROVIDED “AS IS.” WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS. USE OF GENERATED CONTENT IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE FEES YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR A REASONABLE CAP FOR FREE USERS).
The Service relies on third parties for authentication, payments, AI inference, analytics, and hosting. Their terms and policies may apply. We are not responsible for third-party acts or outages.
You may delete your account at any time. We may suspend or terminate access for violations, inactivity, or legal compliance, with or without notice where permitted. Sections on payment, intellectual property, disclaimers, and liability survive termination.
These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. Disputes shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance, except where mandatory consumer protection laws provide otherwise.
We may modify these Terms. Material changes will be posted on the Service. Continued use after changes constitutes acceptance.
